The Framingham Adult ESL PLUS PROGRAM, good at hiding criminality

This statement below entails basically our concerns about this program. As Framingham Town Meeting members we would like the Town of Framingham to open up an investigation into the Framingham Adult ESL Plus program. The reasons for this is because we as a Town meeting made request through a Resolution dated May 1, 2013, that the Framingham Adult ESL Plus program comply to: “have a policy of verification of legal status with appropriate documents at the time of enrollment in this program” The fact that this program has not responded to this request from Town meeting to satisfy a Town Memorandum dated March 21, 2013 that ask for “EXPLICITLY checking the immigration status on their respective client intake forms” leads us to believe that this program has no interest in supplying that information and shows they are hiding important information about the immigration status of its clients in serious violation of established Federal Law, which is a FELONY. According to that Memorandum:

As Town entities all three agencies Framingham Adult ESL Plus sponsored by the School Department Literacy Volunteers of America ( LVA ) sponsored by the Public Library Resiliency for Life (RFL )— sponsored by the School department “are required to comply with the 1996 Welfare Reform Act and other federal requirements for checking immigration status of all participants”. The Adult ESL Plus program does a cursory “check box check” but no other serious EXPLICIT checks at all. Since Town money through Federal funding comes into this program, and the other two mentioned programs, we feel this is a serious misuse of tax dollars not to mention that the use of our public schools buildings are being used in violation of Federal Immigration and Nationality Act Sections USC 1324 (a)(1)(A)(iv)(b)((iii)

Federal Immigration and Nationality Act Section 8 USC 1324(a)(1)(A)(iv)(b)(iii) “Any person who . . . encourages or induces an alien to . . . reside . . . knowing or in reckless disregard of the fact that such . . . residence is . . . in violation of law, shall be punished as provided . . . for each alien in respect to whom such a violation occurs . . . fined under title 18 . . . imprisoned not more than 5 years, or both.” Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A) A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he: * assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or * encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or * knowingly assists illegal aliens due to personal convictions. It is our concern that current Immigration law is being broken through aiding and abetting and document fraud statutes violations, leaving Framingham in a legal bind. We ask that the Board of Selectperson through its legal department look into these serious allegations and make sure our Town voted resolution is adhered to EXPLICITLY.

Oh look who has favored the criminal ESL PLUS PROGRAM, none other than our Framingham board of Selectpersons.

A quick check of that ESL program shows a ton of Brazilians, and guess what? MOST BRAZILIANS ARE UNDOCUMENTED according to this Harvard paper on page 8.
